1. Agreement to Terms

By accessing or using AIOps (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service.

3. Description of the Service

AIOps provides AI-powered infrastructure automation for Google Cloud Platform. The Service generates, validates, and deploys Terraform infrastructure code using artificial intelligence. The Service may generate Terraform configurations, cost estimates, and deployment plans based on user-provided prompts and requirements.

4. IMPORTANT DISCLAIMER (No Infrastructure Warranty)

The Service is provided for infrastructure automation assistance only. The Service does not provide infrastructure, cloud architecture, security, compliance, or other professional advice.

All Terraform code, infrastructure configurations, and deployment plans generated by the Service are not guaranteed to be accurate, secure, compliant, or suitable for your specific use case. You are solely responsible for:

• Reviewing all generated Terraform code before deployment
• Validating infrastructure configurations for security and compliance
• Testing infrastructure changes in non-production environments
• All infrastructure changes and their consequences
• Ensuring compliance with applicable laws, regulations, and organizational policies
• Backing up critical data before making infrastructure changes

Always consult qualified infrastructure and security professionals before deploying infrastructure changes to production environments.

5. Accounts and Security

You may need to create an account or authenticate to access certain features. You agree to provide accurate information and keep your account secure. You are responsible for all activity that occurs under your account, including all infrastructure changes made through the Service.

6. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Attempt to gain unauthorized access to systems or user accounts
• Interfere with or disrupt the Service (including abuse, excessive automated requests, or denial-of-service attempts)
• Circumvent usage limits, access controls, or security measures
• Use the Service to deploy infrastructure that violates applicable laws, regulations, or third-party rights

7. Prohibited Data Extraction and Misuse

You agree not to:

• Scrape, harvest, copy, or extract data, outputs, or content from the Service through automated means
• Use the Service to build, train, or improve competing products or machine learning models
• Reverse engineer or attempt to discover the underlying models, algorithms, or proprietary methodologies
• Decompile, disassemble, or otherwise attempt to derive source code or underlying structure
• Share, sell, sublicense, or otherwise provide access to the Service (including access credentials, API keys, or authentication links) to any third party

8. Intellectual Property

All content, features, functionality, and technology of the Service—including software, models, algorithms, data, outputs, text, graphics, user interface, configurations, design, and documentation—are owned by Sundiata Solutions, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. No rights are granted to you except as expressly set forth in these Terms.

Your Data and Infrastructure Configurations: You retain ownership of your infrastructure configurations, Terraform code that you provide or modify, and any data you submit to the Service. However, you grant Sundiata Solutions, LLC a license to use such data to provide and improve the Service.

Generated Code: Terraform code generated by the Service is provided for your use, but the Service itself, including the AI models and generation algorithms, remain the property of Sundiata Solutions, LLC.

Except as expressly permitted by these Terms, you may not copy, modify, reproduce, distribute, publicly display, create derivative works of, or otherwise exploit any portion of the Service or its content.

9. Paid Features (Planned)

The Service may introduce paid features, subscription plans, or other monetization options in the future. If and when paid features are introduced, pricing, renewal terms, cancellation terms, and any applicable refund policy will be presented at the time of purchase and/or in updated Terms.

10. Third-Party Services

The Service relies on third-party services, including Google Cloud Platform, Vertex AI, Cloud Build, Firestore, and Cloud Storage. We are not responsible for third-party service outages, changes, or limitations. Your use of the Service may be subject to additional terms and conditions from these third-party providers.

11. Availability and Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. We do not guarantee the Service will be uninterrupted or error-free. The Service may experience downtime due to maintenance, third-party service outages, or other factors beyond our control.

12. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you violated these Terms or if necessary to protect the Service, users, or third parties. You may stop using the Service at any time.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNDIATA SOLUTIONS, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED. WE DO NOT WARRANT THAT GENERATED TERRAFORM CODE WILL BE ACCURATE, SECURE, COMPLIANT, OR SUITABLE FOR YOUR USE CASE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNDIATA SOLUTIONS, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

INFRASTRUCTURE CHANGES: YOU ARE SOLELY RESPONSIBLE FOR ALL INFRASTRUCTURE CHANGES MADE THROUGH THE SERVICE. SUNDIATA SOLUTIONS, LLC WILL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR COSTS ARISING FROM:

• Infrastructure deployments, modifications, or deletions
• Data loss, service outages, or security breaches resulting from infrastructure changes
• Compliance violations or regulatory issues
• Costs incurred from infrastructure deployments (including but not limited to cloud service charges)
• Errors, bugs, or inaccuracies in generated Terraform code

IN NO EVENT WILL SUNDIATA SOLUTIONS, LLC'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID (IF ANY) TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100 USD.

15. Indemnification

You agree to indemnify and hold harmless Sundiata Solutions, LLC from claims arising out of your use of the Service, your infrastructure deployments, or your violation of these Terms.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. You agree that any dispute will be brought in courts located in Delaware, unless otherwise required by law.

17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will post updated Terms on the website. Continued use after changes means you accept the updated Terms.
